Terms & Conditions
Last updated: September 1, 2026
These Terms and Conditions apply to all bookings, payments, surf lessons, surf trips, transportation arrangements, and other services provided by TGS Surf Experiences. By making a reservation, submitting payment, or participating in an activity, the customer and all participants included in the booking agree to these Terms and Conditions.

SERVICES
TGS Surf Experiences provides surf lessons, surf trips, equipment used during scheduled activities, and related transportation or pick-up services as described on www.tgssurf.com.
Activities may take place in Tamarindo, Playa Grande, Avellanas, or another suitable surf location in Guanacaste, Costa Rica. The final beach, meeting point, and activity time may be confirmed or adjusted according to ocean conditions, tides, weather, participant experience, safety, and operational requirements.
2. BOOKINGS AND CONFIRMATION
A booking is confirmed after the required booking information and payment have been successfully received and the customer receives a confirmation from TGS Surf Experiences.
Customers are responsible for providing complete and accurate contact, participant, accommodation, and pick-up information. TGS Surf Experiences is not responsible for delays or missed communications caused by incorrect or incomplete information provided by the customer.
The person making the booking is responsible for sharing these Terms and Conditions with every participant included in the reservation. Online bookings must be completed at least 2 hours before the scheduled start time.
3. PRICES AND PAYMENTS
Prices are displayed on the website or communicated directly before payment. Payment must be completed using one of the payment methods accepted through the website or approved by TGS Surf Experiences.
Payment processing may be handled by Wix, PayPal, or another third-party payment provider. Additional processing times, currency conversions, or bank procedures may depend on the customer’s payment provider.
4. CUSTOMER CANCELLATIONS
Customers who cancel at least 24 hours before the scheduled start time are eligible for a full refund of the amount paid for the canceled activity.
Cancellations received less than 24 hours before the scheduled start time are non-refundable. The 24-hour deadline is strict. A cancellation received after the deadline, even by one minute, is considered a late cancellation and does not qualify for a refund.
Cancellations must be submitted through the online booking system or communicated directly to TGS Surf Experiences by email or WhatsApp. The cancellation time will be determined by the time the online cancellation or message is received.
5. CUSTOMER RESCHEDULING
Requests to reschedule must be received at least 24 hours before the scheduled start time and are subject to availability.
Requests received less than 24 hours before the activity may be treated as late cancellations and do not guarantee a new date, credit, or refund.
6. NO-SHOWS AND LATE ARRIVALS
Participants who do not attend their scheduled activity are considered no-shows and are not eligible for a refund or credit.
Customers should be ready at the confirmed meeting or pick-up time. Late arrival may reduce the duration of the activity. If the delay makes it impossible or unsafe to provide the service, the booking may be treated as a no-show without a refund.
7. WEATHER, OCEAN CONDITIONS, AND TGS CANCELLATIONS
Surfing depends on changing natural conditions. TGS Surf Experiences may change the start time, beach, route, or activity plan when reasonably necessary because of tides, waves, weather, safety, road access, participant ability, or other operational circumstances.
A reasonable change of beach or time does not automatically constitute a cancellation when TGS Surf Experiences can still safely provide the booked activity.
If TGS Surf Experiences determines that the activity cannot be safely or reasonably provided and cancels the service, the customer may choose between:
• Rescheduling the activity, subject to availability; or
• Receiving a full refund of the amount paid for the canceled activity.
TGS Surf Experiences is not responsible for additional expenses such as accommodation, flights, meals, independent transportation, or other travel arrangements.
8. SURF CONDITIONS AND RESULTS
Wave size, weather, water visibility, tides, crowds, and other natural conditions cannot be guaranteed.
TGS Surf Experiences will make reasonable efforts to select an appropriate location and provide a safe, enjoyable experience, but cannot guarantee specific waves, surfing progress, photographs, wildlife sightings, or individual results.
9. PARTICIPANT RESPONSIBILITIES
Participants must:
• Follow all safety instructions given by the instructor or guide
• Use the equipment as instructed
• Behave responsibly toward instructors, other participants, beach users, and the environment
• Inform TGS Surf Experiences about their swimming ability and surfing experience
• Disclose any medical condition, injury, allergy, medication, disability, or other circumstance that may affect safe participation
• Avoid participating while under the influence of alcohol, illegal drugs, or any substance that may impair judgment or physical ability
TGS Surf Experiences may refuse or stop a participant’s activity when their behavior, physical condition, failure to follow instructions, or level of intoxication creates a safety risk. A refund is not guaranteed in these circumstances.
10. INHERENT RISKS
Surfing, swimming, transportation, and beach activities involve inherent risks. These may include changing waves and currents, shallow water, reefs, rocks, marine life, weather, collisions, falls, equipment-related injuries, road conditions, and the actions of other people.
By participating, each participant acknowledges these inherent risks and voluntarily chooses to take part in the activity.
Nothing in these Terms and Conditions excludes any responsibility that cannot legally be excluded under applicable law.
11. HEALTH AND FITNESS
Participants are responsible for determining whether they are physically and medically able to participate.
TGS Surf Experiences must be informed before the activity of any relevant health or safety concern. Providing this information does not guarantee that participation will be approved. The instructor may modify or refuse participation when reasonably necessary for the safety of the participant or others.
12. MINORS
Participants under 18 years of age must have authorization from a parent or legal guardian.
The parent or guardian making or authorizing the booking confirms that the minor is permitted to participate and that all relevant medical, swimming, and safety information has been provided.
A parent, guardian, or responsible adult may be required to remain present depending on the participant’s age, ability, and the type of activity.
13. EQUIPMENT
Equipment supplied by TGS Surf Experiences must be used responsibly and only during the scheduled activity.
Participants may be held responsible, to the extent permitted by law, for equipment that is intentionally damaged, lost through reckless behavior, or used contrary to the instructor’s directions. Normal wear and accidental damage arising from proper use are excluded.
14. TRANSPORTATION AND PICK-UP
Complimentary pick-up may be available within the service area and must be confirmed in advance by TGS Surf Experiences.
Pick-up times and routes may change because of traffic, road conditions, weather, beach selection, or other operational requirements. Customers must provide accurate accommodation information and be ready at the agreed location and time.
Personal belongings left in a vehicle, at the beach, or at another meeting location remain the participant’s responsibility.
15. PHOTOGRAPHS AND MEDIA
TGS Surf Experiences will request permission before using an identifiable participant’s image for advertising, website content, or social media.
A participant may decline promotional photography without affecting their ability to receive the booked service.
16. PRIVACY
Personal information collected during bookings, payments, communications, and activities is handled according to the TGS Surf Experiences Privacy Policy available on www.tgssurf.com.
17. WEBSITE AND THIRD-PARTY SERVICES
TGS Surf Experiences makes reasonable efforts to keep website descriptions, availability, and prices accurate. Errors may occasionally occur and will be corrected when identified.
Third-party services, including Wix, PayPal, maps, social media platforms, and review or travel websites, operate under their own terms and policies.
18. APPLICABLE LAW
These Terms and Conditions are governed by the applicable laws of Costa Rica.
If a disagreement occurs, the customer and TGS Surf Experiences should first attempt to resolve it directly and in good faith. Any unresolved matter will be handled by the competent authorities or courts under applicable Costa Rican law.
19. CHANGES TO THESE TERMS
TGS Surf Experiences may update these Terms and Conditions when services, booking procedures, providers, or legal requirements change.
The version applicable to a reservation is the version published or provided when the booking is made, unless a later change is required by law or accepted by the customer.
